A2A SMS provides account holders with a powerful method of communicating directly
with mobile phone users via Text message and email, all the following is deemed
to be both email and sms.
Because of the personal nature of Text Messaging and mobile phones in general
- all A2A SMS Account Holders must comply with the following A2A SMS Codes Of
Practice.
Due to the nature and speed of change in the wireless marketing industry this
Code of Practice will be monitored and may be updated from time to time to take
account of changes in technology or society and all A2A SMS Account Holders
must adhere to such amended or updated Code of Practice.
1. Scope of this Code of Practice:
1.1. The following Codes of Practice relate to the provision of Text Message
services using the A2A SMS application.
1.2. The A2A SMS Codes of Practice shall include but are not limited to, the
ICSTIS Code (or Codes) of Practice, the Wireless Marketing Association Code
(or Codes) of Practice, the Data Protection Act 1998, the Consumer Protection
(Distance Selling) Regulations 2000 (SI No 2334), the relevant provisions of
the Telecommunications Act 1984, any direction of the Director General of Telecommunications
or other competent authority, any applicable legislation law or Code Of Practice
regulating the provision of services such as those provided by the A2A SMS facility.
2. Definitions:
2.1. A2A SMS Account Holder - means any business or individual with access
to the A2A SMS application
2.2. Service User - means any person who is connected to a UK Mobile Phone
network.
2.3. Captured Mobile Number - means a Service User's mobile number that has
been captured via the A2A SMS facility. Service User's mobile numbers are captured
and made available to the A2A SMS Account Holder each time the Service User
uses any of the Account Holder's A2A SMS Text Message services.
3. A2A SMS Resellers:
3.1. A2A SMS Resellers must use all reasonable endeavors to ensure that when
a new A2A SMS account is sold, and at all times during the provision of access
to the A2A SMS facility, all parties adhere to the A2A SMS Codes of Practice.
4. Message Services & Content:
4.1. General
4.1.1. All A2A SMS Text Message services must be clear and unambiguous, legal,
decent, honest and truthful.
4.1.2. A2A SMS Account Holders shall not at any time provide any Short Message
or Short Message Service, which is or may be a criminal offence or is or may
otherwise be unlawful.
4.1.3. A2A SMS Account Holders must ensure that before any A2A SMS message
service or code is made available to Service Users all such rights, authorisations,
licences, consents and permissions regarding the content of the service have
been obtained or granted as may be necessary.
4.1.4. A2A SMS account holders make all reasonable endeavours to ensure that
no A2A SMS message services or A2A SMS messages are promoted to, or sent to,
Services Users under 18 years of age where the nature or content of such A2A
SMS services or messages is not suitable for Service Users under 18 years of
age.
5. Promotion of A2A SMS Codes and A2A SMS Text Services:
5.1. General: All publicity / promotional material for A2A SMS Text Messages
Services and A2A SMS Codes must:
5.1.1. Clearly display the A2A SMS customer service number. (015395 64486)
5.1.2. Clearly state that by using a A2A SMS service or code, Service Users
may receive promotional text messages from, and related to, the A2A SMS Account
Holder that provided the original service. The following statement would be
acceptable - "By using A2A SMS code you are giving the service provider
permission to send a limited number of promotional messages to your mobile number."
5.1.3. Clearly explain the type and nature of the service to the Service User.
5.1.4. Clearly display the A2A SMS name and logo.
5.1.5. Where appropriate, comply with The British Codes of Advertising and
Sales Promotion.
6. Captured mobile numbers: All communication with mobile numbers captured
by the A2A SMS service:
6.1. Must be conducted responsibly and within the relevant codes or practice
and guidelines including, but not limited to, any relevant rulings made by ICSTIS,
the Advertising Standards Authority and the Wireless Marketing Association.
6.2. Must be related to the Account Holder's A2A SMS service that originally
captured the mobile number(s)
6.3. Must not worry or annoy any mobile phone users or be used for any other
unlawful purpose.
7 A2A SMS reserves the right to terminate any account without notice.
